I'd guess this might be the only basis for a valid argument in this case, you could argue a breach of description (ie: no actual chance of achieving said amount of time after a certain period) or even just misrepresentation (misleading advertising). EDIT: Having said that, what would you be looking for in such a circumstance? Breach of contract for consumers usually just means a refund... you couldn't even really argue consquential losses unless you could actually demonstrate you've incurred financial losses directly resulting from the breach. So it's all just posturing.
  19. Most of the laws that apply in this situation in my neck of the woods at least come from the Sale of Goods Act 1979 and the Supply of Goods and Services Act 1982... to us Brits the European Constitution is just a headache!
  20. Actually there is a valid point in the post you've replied to. In UK law at least, your contract is with the seller, not with the manufacturer, not with the supplier, not with the designer and not with the importer. All legal responsibilities for your purchase lie with the person you purchase from. Now given the subscription you could argue the game is a service, and it's pretty obvious that the service part of the contract would lie with BW...
  21. Believe it or not I completely agree with most of your points. The EULA is an entirely seperate subject and, to my knowledge, agreements like it have yet to be tested in a court of law (at least in the UK). Customer service, sadly, is not a legal requirement. A high level of customer service is not mandatory and I do believe it should be, unfortunately though I don't make those rules. The best advice is and always has been that consumers need to vote with their feet. Business will only trade certain goods and behave in a certain way for as long as consumers go along with it, it's the customer's buying power that ultimately influences policy and direction. Don't like it, walk away, if enough people do it then the business starts to listen - that's exactly what I did with Cryptic studios, just wish a few more had followed suit...

I would like to point out though to those who feel genuinely cheated: There were scores of forum posts detailing how EGA would be implemented For those not into forums, there was an EGA faq which answered many questions, including how it would be rolled out The $5/£5 charge is not a charge for early access, it is a pre-order charge for the cost of your game, released on December 20th, and taken out of the final amount payable
  23. I used to advise consumers on their legal rights for a living, so I know a thing or two about these kinds of things. You'd be surprised how often a customer fails to take responsibility for entering into contracts without reading, or understanding, the terms and conditions. The responsibility does not lie with the trader, they've furnished you with all the information they are prepared to give and asked you to make a decision whether or not you want to purchase. Remember that, as a customer it is YOUR DECISION. You entered into this contract knowing (or failing to notice) that you were not GUARANTEED the full amount of EGA time. Either you didn't understand it, or you chose to ignore it. Unfortunate as that is for you it isn't BWs responsibility, it's yours for taking that decision. If you don't like a deal, you're under no duress to accept it, just walk away. If you choose to go through with it, have the courage of your convictions.
  24. Well the date that was announced was the 20th December. EGA is not the LIVE launch, it's for pre-orders only, will be handled in the form of "waves" of players, originally spread over 5 days, based on when the pre-order code was entered as well as location. It was all there for everyone to see, in plain text. Nothing complicated, nothing underhanded, all very simple for those who took the time to pay attention. I booked off next Monday/Tuesday on the basis that I hoped to be in by the weekend and figured I'd almost definately be in by Monday 19th - caution, that's more an adult's approach I believe.
